PHB Realty Company, LLC dba Kansas City Homes is a Kansas limited liability company (“Kansas City Homes,” “we,” “our,” or “us”). Kansas City Homes owns, operates, and/or maintains www.kansascityhomes.com, other websites or mobile applications, services or products on which this notice appears or is linked (the “Sites”).

Kansas City Homes respects the online privacy of personal information that you provide us through the Sites. If you have any questions about our policy or our practices with regard to your personal information, please contact us at webmaster@kansascityhomes.com.

This policy (“Privacy Policy”) describes the manner in which Kansas City Homes collects, uses, maintains, and discloses information collected from users (each, a “User”) of the Sites, and our related services, except where otherwise stated. The Sites are intended for use by persons 18 years of age or older. This Privacy Policy may be updated from time to time, so please check back for updates.

1. Your acceptance of this policy

Please read this Privacy Policy carefully. By using the Sites, you agree to the terms of this Privacy Policy and our Terms of Use. If you do not agree to this Privacy Policy, do not use our Sites. Your continued use of the Sites following the posting of changes to this Privacy Policy will be considered your acceptance of those changes.

2. Information we collect

Kansas City Homes collects information about you when you use our Sites, products, and services. The kinds of information we collect from you will vary depending on how you use our Sites, products, and services. We automatically collect information from you when you visit and interact with our Sites; this information does not personally identify you. We may also collect information from you that does personally identify you, if you choose to provide us with that information. To learn about opting out and limiting information gathering, see Section 8 of this policy.

(a) Non-personally identifiable information collected from your use of our Sites

We collect information and data about Users whenever they interact with our Sites. Our systems are set up to gather certain data to help us better understand how the Sites are being used and how we can improve it.

This information and data are not linked to you personally, so it does not include your name, contact information, username, password, or other similar information. This information may include your Internet Protocol address, browser name/type, the type of computer or device you use and other technical information about your means of connection to our Sites, such as the operating system and the Internet service providers, statistics about how you navigate and use through our Sites, and information provided through the use of cookies and web beacons (which is described in more detail below), geographic location, and other similar information.

(b) Web browser cookies, web beacons, and similar tracking technology

The Sites use cookies, web beacons, tracking pixels, and similar tracking technology. Cookies are small files, text, or a piece of data that are sent to and stored on your computer or device. We use cookies so that we, and third parties that provide services for our Sites, can recognize your computer or device as a unique machine the next time you visit our Sites. Cookies have different durations depending on the type of cookie and its purpose. We use this technology for record-keeping purposes and sometimes to track information about Users for the following reasons:

  • Authenticating Users and remembering User settings for your convenience;
  • Altering our content depending on your browsing patterns;
  • Tailoring advertisements (both on and off our Sites) for products and services;
  • Understanding the size of our audience and their traffic patterns within our network; and
  • Analyzing and researching other measures to help us pursue similar goals.

You may choose to set your web browser to refuse cookies or to alert you when cookies are being sent. Generally, this is done by selecting the appropriate cookies setting on your web browser (usually found in “Internet Options” or “Preferences”). Please note that if you do use such settings, some parts of our Sites may not function properly. See Section 8 for information on Global Privacy Control and other automated opt-out signals.

(c) Third-party cookies, analytics, and advertising

We use Google Analytics Advertising services to obtain demographic data about Users of the Sites. Google uses a cookie that can be recognized by Google or its affiliates when you visit other websites to show advertisements across the Internet. Because this technology allows Google and its advertising partners to recognize your device across websites for advertising purposes, it is considered a “sale” or “share” of personal information under the California Consumer Privacy Act and similar laws in other states, even though Kansas City Homes does not receive any money for it. See Section 5 and Section 9 for more detail and for how to opt out.

We also use a customer relationship management (CRM) platform to manage inquiries, showing requests, and communications you submit through the Sites. Information you submit through a form on the Sites (such as your name, contact information, and preferences) is stored in that CRM and may be accessed by the Kansas City Homes agent or broker associated with your inquiry. Our CRM provider acts as our service provider and is contractually restricted from using your information for its own purposes.

You can opt out of your data being used by Google Analytics by clicking here (https://tools.google.com/dlpage/gaoptout/) and following the instructions provided by Google.

(d) Personally identifiable information that you disclose to us on the Sites

We will collect personally identifiable information from you only if you voluntarily choose to submit such information to us. The choices that you make with regard to the Sites, products, and services will determine when and what type of personally identifiable information is collected. For example, certain personally identifiable information will be requested when you register on our Sites, fill out forms, such as a request for a showing appointment, and in connection with other activities, services, features, or resources we make available on our Sites.

If you choose to take advantage of some of our Site features, products, and services, you may be asked for the following personally identifiable information:

  • Name and contact information, including first and last name, email address, mailing address, phone number, and other similar contact data;
  • Credentials, such as username, password, challenge questions, and similar security information used for authentication and account access;
  • Preferences, such as whether you are buying or selling a home, what neighborhood or location you are interested in, and other similar information;
  • Agent or broker information.

If you provide a mobile phone number through a Site form, you may separately be asked to consent to receive text messages about your inquiry. See Section 2(g) below for how we, or a vendor acting on our behalf, use that information.

Providing us with personally identifiable information is always optional; however, certain features, products, or services may not be available to you without the submission of personally identifiable information.

(e) Personally identifiable information from other sources

In addition to the personally identifiable information that you disclose to us, we may also obtain information from other sources, and we may collect and combine that information with information collected from you via the Sites. For example, if you used a social media platform (such as Facebook), Google, or another third-party service to create your account on Kansas City Homes, then we may make use of the data that they provide to further customize your experience on the Sites in accordance with that third party's procedures. Additionally, we may collect information about you from real estate agents or brokers, our CRM provider, credit bureaus, and other publicly available sources which may include information related to home sales and purchases, property taxes, and other related information.

(f) Personally identifiable information not subject to this policy

If you decide to work with Kansas City Homes to buy or sell a home, then you will work directly with a Kansas City Homes agent. As part of the process of buying or selling a home, you will need to provide information that is customary for the home purchase or sales process. This information might include your name, address, phone number, email address, birthday, financial documentation, such as a loan pre-approval documentation, and/or information about the property you are hoping to purchase or sell. This information is separate from the personally identifiable information we collect on the Sites and is not covered by this Privacy Policy or our Terms of Use.

(g) Text messaging (SMS) communications

If you provide your mobile phone number to Kansas City Homes or to one of our teams — for example, when requesting a home showing or scheduling an appointment — you may receive text messages to confirm appointments, send reminders, or notify you of schedule updates or other changes related to your inquiry. Some or all of our teams use a third-party appointment-scheduling and messaging service to send these texts on our behalf; that vendor acts as our service provider for this purpose and is contractually restricted from using your phone number or SMS consent for any purpose other than delivering these messages to you.

No mobile phone number or SMS opt-in consent is shared with third parties or affiliates for their own marketing or promotional purposes. This applies regardless of any other data-sharing practices described elsewhere in this Privacy Policy, and it does not limit our ability to share this information with the service provider described above solely to deliver the text messages you have requested.

Text messaging is optional and separate from your ability to use the Sites. You may opt out of text messages at any time by replying STOP; we (or our vendor) will send a confirmation message and then send no further texts unless you sign up again. Reply HELP for assistance, or contact us at webmaster@kansascityhomes.com. Message and data rates may apply, and message frequency varies; contact your wireless carrier with questions about your plan. Carriers are not liable for delayed or undelivered messages. This texting program is also governed by the Telephone Consumer Protection Act and by any additional terms presented to you at the time you opted in.

Terms and Conditions

We use SMS to confirm appointments, send reminders, and notify clients of schedule updates or important changes.

You can cancel the SMS service at any time. Just text "STOP." After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time, and we will start sending SMS messages to you again.

If you are experiencing issues with the messaging program, you can reply with the keyword "HELP" for more assistance, or you can get help directly at webmaster@kansascityhomes.com.

Carriers are not liable for delayed or undelivered messages.

As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency may vary. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

3. How we use collected information

Kansas City Homes uses your information for purposes based on your consent, our legitimate business interests, and our legal and compliance obligations. Specifically, we use the personally identifiable information we collect from you to:

  • Provide, maintain, and improve our Sites, products, and services, including creating and managing your account;
  • Provide and deliver information, products, and services requested by you;
  • Arrange home tours;
  • Respond to your customer service requests and support inquiries;
  • Improve our customer service;
  • Personalize User experience;
  • Market products or services that may be of interest to you;
  • Communicate with you through periodic emails or updates, which may include marketing or promotional communications, newsletters, technical notices, security alerts, and other administrative messages;
  • Validate your identity;
  • Track usage of our Site;
  • Perform other tasks for which the information was collected.

Additionally, we will disclose personal information when we believe in good faith that such disclosures (a) are required by law, including, for example, to comply with a court order or subpoena, or (b) will help to: enforce our policies; protect your safety or security, including the safety and security of property that belongs to you; and/or, protect the safety and security of our Sites or third parties.

We use non-personally identifiable information we collect from you to:

  • Analyze traffic and usage of our Sites;
  • Compile anonymous statistical data and analysis for use internally or with third parties;
  • Analyze information in the aggregate to understand how our Users as a group use the services and resources provided on our Sites;
  • Target promotional activities;
  • Improve our Sites, products, and services.

We do not use sensitive personal information (see Section 5) for any purpose beyond what is reasonably necessary to provide the Sites and the services you request, unless you separately direct us to do otherwise.

4. Information sharing; sale and sharing of personal information 

Kansas City Homes does not sell, trade, or rent your personal information for money. However, as described in Section 2(c), our use of advertising cookies (such as Google Analytics Advertising) may constitute a “sale” or “share” of personal information under California and other states' privacy laws because it allows a third party to recognize your device for cross-context behavioral advertising. We do not sell or share sensitive personal information, and we do not sell or share the personal information of Users we know to be under 16 years of age.

As part of our normal business operations, we may share information about you with:

  • The real estate agent(s) or broker(s) to whom your inquiry or account is associated;
  • Our employees and personnel who need the information to do their jobs;
  • Our corporate affiliates and franchisor;
  • Our CRM provider, our text-messaging/appointment-scheduling vendor described in Section 2(g), and other vendors and consultants who perform services on our behalf (service providers), under contracts that restrict them from using your information for their own purposes;
  • Analytics and advertising partners, such as Google, as described in Section 2(c);
  • A buyer or successor in the event of a merger, acquisition, or sale of some or all of our assets, subject to this Privacy Policy (or a policy at least as protective); and
  • Government authorities or other third parties as required by law or as described in Section 3.

We may share generic aggregated demographic information not linked to any personally identifiable information regarding visitors and users with our business partners, trusted affiliates, and advertisers for the purposes outlined above.

See Section 5 for the categories of personal information we have disclosed, sold, or shared in the preceding 12 months, and Section 9 for how to opt out of the sale/share of your personal information.

5. Categories of personal information we collect, disclose, and share 

The table below summarizes, for the preceding 12 months, the categories of personal information we collect through the Sites, whether we disclose each category to service providers to operate the Sites, and whether each category has been sold or shared for cross-context behavioral advertising as described in Section 2(c). This table is provided to comply with California and similar state law requirements and supplements, rather than replaces, the narrative descriptions in Sections 2 and 4.

We have not sold or shared any category of personal information in exchange for money. Where this table indicates a category may be “Sold / Shared,” it refers only to the cookie-based advertising practice described in Section 2(c), which you can opt out of as described in Sections 8 and 9. Mobile phone numbers and SMS opt-in consent collected for the text-messaging program described in Section 2(g) are never sold or shared for marketing purposes, by us or by any vendor acting on our behalf.

6. How we store and protect your information

Kansas City Homes is a company based in the United States, and we process and store information on our servers located in the United States (and/or through our cloud service providers, including our CRM provider, located in the United States). As such, your data may be transferred outside of the country where you live. By accessing or using our Sites, products, or services, you consent to the processing, transferring, and storage of information in and to the United States.

We follow generally accepted standards to protect the information we collect. We test our security procedures regularly and modify them as new technologies become feasible. We store our servers in a locked, secure environment. We retain the information we collect only for as long as reasonably necessary for the purpose(s) for which we collected it, or as required by law; personal information collected from a User we know to be a minor is retained only as long as reasonably necessary to fulfill the purpose for which it was collected and is not used to further retain or re-engage that minor.

While we take reasonable measures to help protect your personal information, please be aware that no security measures are 100% secure. In the event of a security incident affecting your personal information, we will notify affected Users and any applicable regulators as required by applicable law. We encourage you to use common sense when disclosing information over the Internet and please immediately let us know if you suspect that information you shared with us is being used in any way contrary to this Privacy Policy. 7. Other links and websites

This Privacy Policy only applies to sites owned and operated by Kansas City Homes. Our pages may contain links to websites and digital properties outside of our control. Please be aware that these websites and digital properties may collect information about you and operate according to their privacy practices that may differ from this Privacy Policy, including the use of cookies, web beacons, and other similar technologies. Remember that once you're outside our Sites, any information you submit is outside of our control.

8. Opting out and universal opt-out (Global Privacy Control) signals 

For Sites that provide the creation and use of user accounts, you may at any time review or change the information in your account by logging in and changing your account information. You can terminate your account with Kansas City Homes at any time. You also have the ability to opt out of any advertising email communication by unsubscribing or emailing us at webmaster@kansascityhomes.com. Even if you deactivate your Kansas City Homes account, we may keep a copy of your account information for our records in accordance with applicable laws.

You may opt out of third-party internet-based advertising on our Sites. You can use the Network Advertising Initiative's multi-cookie opt-out mechanism at http://optout.networkadvertising.org, or the Digital Advertising Alliance Opt-out Tool at http://optout.aboutads.info. Additionally, you can find more information about “do not track” options at http://www.allaboutdnt.com. To opt out of text messages, see Section 2(g).

Global Privacy Control 

Our Sites are configured to detect and honor the Global Privacy Control (“GPC”) signal, a browser- or extension-based signal that communicates a request to opt out of the sale or sharing of personal information, where required by applicable law. If you visit our Sites with GPC enabled, we will treat that signal as a valid request to opt out of the sale/share of your personal information for that browser, and we will display a confirmation that your request has been processed. GPC operates at the browser or device level, so you will need to enable it on each browser and device you use. You can also opt out manually using the “Your Privacy Choices” link in the Sites' footer.

9. Your privacy rights 

This section describes rights that may be available to you under applicable law, depending on where you live. It replaces and expands the prior version of this section, which addressed only European Economic Area and California Users.

(a) U.S. state privacy rights (all states)  

If you are a resident of a U.S. state with a comprehensive consumer privacy law (which, as of this update, includes California, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Florida, Montana, Iowa, Delaware, New Jersey, New Hampshire, Nebraska, Minnesota, Maryland, Tennessee, Indiana, Kentucky, Rhode Island, and others as additional state laws take effect), you may have some or all of the following rights, subject to certain exceptions under the applicable law:

  • Right to confirm whether we process your personal information and to access it;
  • Right to correct inaccurate personal information;
  • Right to request deletion of your personal information;
  • Right to receive a copy of your personal information in a portable format;
  • Right to opt out of the sale or sharing of your personal information and of targeted advertising;
  • Right to opt out of profiling in furtherance of decisions that produce legal or similarly significant effects;
  • Right to limit the use and disclosure of sensitive personal information;
  • Right to appeal our decision on your request; and
  • Right to be free from unlawful discrimination for exercising any of these rights.

We will need to verify your identity before responding, using information you have already provided to us; if we cannot verify your identity, we may request additional information. You may designate an authorized agent to submit a request on your behalf; we may require proof of the agent's authority and may still need to verify your identity directly. We will respond within the time required by applicable law (generally 45 days, which may be extended once by an additional 45 days when reasonably necessary). If we decline to act on your request, you may appeal by replying to our response, and, if your appeal is denied, applicable law may give you the right to contact your state Attorney General.

(b) Additional disclosures for California residents  

In addition to the rights described in Section 9(a), California residents have specific rights and are entitled to the following additional disclosures under the California Consumer Privacy Act, as amended by the California Privacy Rights Act:

  • Section 5 of this Privacy Policy lists, for the preceding 12 months, the categories of personal information we have collected, the categories disclosed to service providers, and the categories sold or shared.
  • We collect personal information from the sources described in Sections 2(d) and 2(e), and we use it for the business and commercial purposes described in Section 3.
  • We do not offer financial incentives in exchange for the collection, sale, or retention of personal information.
  • You may submit a request to opt out of the sale/share of your personal information using the “Your Privacy Choices” link in the Sites' footer, by enabling Global Privacy Control as described in Section 8, or by contacting us at webmaster@kansascityhomes.com. We will confirm on the Sites that a Global Privacy Control opt-out request has been received and honored.
  • Under California's “Shine the Light” law, California residents may also request information about our disclosure, if any, of certain categories of personal information to third parties for their own direct marketing purposes during the preceding calendar year, and the names and addresses of those third parties, by contacting us at webmaster@kansascityhomes.com.

(c) Additional note for Texas residents  

The Texas Data Privacy and Security Act applies broadly to businesses that conduct business in Texas and process Texas residents' personal data, without the revenue or data-volume thresholds used by some other states. Texas residents may exercise the rights described in Section 9(a) by contacting us at webmaster@kansascityhomes.com.

(d) European Economic Area and United Kingdom Users 

If you are located in the European Economic Area or the United Kingdom, you may have additional rights under the General Data Protection Regulation or the UK GDPR, including the right to:

  • Access and receive a copy of your personal data;
  • Rectify any personal data that is inaccurate;
  • Request deletion of personal data;
  • Object to, or request that we restrict, our processing of your personal data;
  • Request that we export your personal data to you or a third party in a portable format; and
  • Withdraw any consent you have previously given us, at any time, without affecting the lawfulness of processing before your withdrawal.

We process your personal data on the basis of your consent, our legitimate interests in operating and improving the Sites, and, where applicable, to take steps at your request prior to entering into a contract with you (for example, to arrange a home showing). Where we transfer personal data from the European Economic Area or United Kingdom to the United States, we do so on the basis of appropriate safeguards, such as the European Commission's Standard Contractual Clauses. If you wish to exercise any of these rights, please contact us at webmaster@kansascityhomes.com. You also have the right to lodge a complaint with your local data protection supervisory authority.

(e) Minors 

The Sites are not intended to collect information from minors under the age of 13, and Kansas City Homes does not knowingly collect personally identifiable information from minors under the age of 13. We do not knowingly sell or share the personal information of minors under 16 without the affirmative opt-in consent required by applicable law, and we do not retain personal information collected from a minor longer than reasonably necessary for the purpose for which it was collected. If you are the parent or legal guardian of a minor under the age of 13, and you think that your minor has given us personally identifiable information, please contact us at webmaster@kansascityhomes.com, and we will take steps to delete it.

10. Changes to this Privacy Policy

Kansas City Homes has the sole discretion to update this Privacy Policy at any time. When we do make changes to the Privacy Policy, we will revise the “Last Update” date at the top and bottom of the policy. We encourage Users to frequently check this page for any changes to stay informed about how we are helping to protect the personal information we collect. You acknowledge and agree that it is your responsibility to review this Privacy Policy periodically. Any changes or modifications will be effective immediately upon posting the updated Privacy Policy on the Sites, and you waive the right to receive specific notice of each such amendment or modification.
